XPARQ Terms of Service

1. Acceptance of Terms

Welcome to XPARQ.

These Terms of Service ("Terms") govern your access to and use of the XPARQ platform, applications, websites, communication services, communities, and related technologies.

By creating an account, accessing, or using XPARQ, you agree to be bound by these Terms.

If you do not agree with these Terms, you must not use XPARQ.


2. About XPARQ

XPARQ is a technology platform currently operated by its development team.

XPARQ provides communication services, digital communities, collaboration tools, artificial intelligence integrations, and related technology-driven services.

Certain features may be modified, expanded, restricted, or discontinued at any time.


3. Eligibility

You must be at least 13 years old to use XPARQ.

Users under the age of 13 are not permitted to create accounts or access platform services.

Additional age-based restrictions may apply to specific features and content.

Users are responsible for providing accurate information during registration.


4. Account Responsibilities

You are responsible for:

  • Maintaining the security of your account
  • Protecting your password and credentials
  • Ensuring information provided is accurate
  • Activities performed through your account

You must notify XPARQ immediately if you suspect unauthorized access to your account.

XPARQ is not responsible for losses caused by compromised user credentials.


5. Acceptable Use

You agree not to:

  • Violate any applicable law
  • Harass, threaten, intimidate, or abuse others
  • Engage in hate speech or discrimination
  • Impersonate another person or organization
  • Distribute malware or malicious software
  • Attempt unauthorized access to systems
  • Conduct fraud or deceptive activities
  • Circumvent platform security controls
  • Interfere with platform operations

Use of XPARQ must remain lawful, respectful, and consistent with community safety.


6. User-Generated Content

XPARQ allows users to create and publish content, including:

  • Posts
  • Comments
  • Messages
  • Images
  • Community discussions
  • Group communications
  • User profiles

You retain ownership of content you create.

By submitting content through XPARQ, you grant XPARQ a limited, non-exclusive, worldwide license to host, process, display, transmit, and distribute such content solely for the purpose of operating and improving the platform.

You remain solely responsible for content you publish.


7. Prohibited Content

The following content is prohibited:

  • Illegal content
  • Child exploitation material
  • Non-consensual intimate imagery
  • Terrorist or extremist content
  • Fraudulent schemes
  • Malware distribution
  • Intellectual property infringement
  • Violent threats
  • Targeted harassment
  • Hate speech
  • Content encouraging self-harm
  • Content violating applicable laws

XPARQ may remove prohibited content without prior notice.


8. Adult Content and Black Hole Zone

Certain platform areas may contain age-restricted content intended only for users aged 18 or older.

Access to adult-oriented content may require:

  • Government ID verification through Stripe Identity
  • Confirmation that you are at least 18 years old
  • User consent
  • Explicit opt-in activation (Black Hole Zone)

Users under 18 years of age may be restricted from accessing such content.

XPARQ reserves the right to modify, restrict, or disable adult-content features at any time to comply with legal or platform requirements.


9. Messaging and Communications

XPARQ provides messaging and communication services.

Private messaging systems may employ encryption technologies designed to protect user communications.

Users are responsible for communications they send through the platform.

XPARQ does not guarantee delivery, availability, or uninterrupted operation of communication services.


10. Voice and Video Services

Voice and video communication features are provided on an "as available" basis.

Communications are protected during transmission using industry-standard security technologies.

Voice and video calls are not recorded by XPARQ as part of normal service operation.

Users remain responsible for complying with local laws concerning communication, recording, and consent.


11. Artificial Intelligence Features

XPARQ may provide access to AI-related tools and integrations.

Certain AI features require users to provide their own third-party API credentials.

When using external AI providers:

  • User requests may be transmitted directly to those providers
  • External providers may apply their own policies
  • XPARQ does not control third-party AI outputs

Users remain responsible for evaluating AI-generated content.

AI-generated content may contain errors, inaccuracies, or misleading information.


12. Community Safety

To protect users, XPARQ may provide:

  • Reporting systems
  • User blocking
  • Mute functions
  • Safety controls
  • Age-gating systems
  • Automated moderation systems

Users are encouraged to report harmful or abusive behavior.


13. Enforcement Actions

XPARQ may investigate suspected violations of these Terms.

If violations occur, XPARQ may:

  • Remove content
  • Restrict visibility
  • Issue warnings
  • Suspend accounts
  • Terminate accounts
  • Restrict feature access
  • Cooperate with lawful requests from authorities

Enforcement decisions may be made without prior notice.


14. Account Suspension and Termination

Users may stop using XPARQ at any time.

XPARQ may suspend or terminate access when necessary to:

  • Protect users
  • Protect platform integrity
  • Enforce these Terms
  • Comply with legal obligations

Termination does not automatically remove all historical records required for legal, security, or operational purposes.


15. Intellectual Property

All trademarks, branding, logos, software, designs, and platform technology associated with XPARQ remain the property of XPARQ or its licensors.

Nothing in these Terms grants ownership rights to users except where expressly stated.

Unauthorized copying, reverse engineering, or redistribution may be prohibited by law.


16. Availability of Services

XPARQ is provided on an "as is" and "as available" basis.

We do not guarantee:

  • Continuous availability
  • Error-free operation
  • Uninterrupted service
  • Compatibility with all devices

Maintenance, updates, outages, or technical failures may occur.


17. Limitation of Liability

To the maximum extent permitted by law:

XPARQ shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from use of the platform.

Users assume responsibility for their use of XPARQ and interactions with other users.

Nothing in these Terms excludes rights that cannot legally be excluded under applicable law.


18. Privacy

Use of XPARQ is also governed by the XPARQ Privacy Policy.

Users should review the Privacy Policy to understand how information is collected, processed, and protected.


19. Changes to These Terms

XPARQ may update these Terms periodically.

Material changes may be communicated through the platform, website, or other reasonable methods.

Continued use of XPARQ after changes become effective constitutes acceptance of the updated Terms.


20. Governing Principles

These Terms are intended to be interpreted in a manner consistent with applicable laws and regulations.

If any provision is determined to be unenforceable, the remaining provisions will remain in effect.
